These Terms and Conditions govern tree services provided by Statement Tree Care. By approving an estimate, the Client agrees to the terms below. We recommend reading them in full.
Authorization & Inherent Risks
By approving this estimate, the Client authorizes Statement Tree Care to perform the tree services outlined. All work will be completed in accordance with industry-standard practices by a licensed and insured contractor. The Client understands that tree work involves inherent risks, including the potential to disturb lawns, landscaping, underground utilities, pavement, and surrounding property.
Property Disturbance & Liability
The Client acknowledges that tree services may result in unavoidable disturbance to lawns, soil, landscaping, driveways, sidewalks, curbing, irrigation systems, and surrounding property, including but not limited to ruts, surface cracking, or cosmetic damage caused by equipment or debris. Statement Tree Care shall not be held liable for such conditions, except in cases of gross negligence.
Warranty & Results Disclaimer
Statement Tree Care performs all work using industry-standard practices; however, we do not warrant or guarantee specific biological or aesthetic outcomes. Trees and shrubs are living organisms, and we cannot guarantee the survival, health, growth, or appearance of any tree or plant following trimming, pruning, removal of nearby trees, or other work. Ground-out stumps may re-sprout, and surface or shallow roots may remain in the soil. Except as expressly stated in writing, all services are provided “as is,” and Statement Tree Care disclaims all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, and except in cases of gross negligence or willful misconduct, Statement Tree Care’s total liability arising out of or related to the services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim. Statement Tree Care shall not be liable for indirect, incidental, consequential, or punitive damages.
Insurance
Statement Tree Care is fully insured for liability, property, and vehicle, as well as proper levels of Workman’s Compensation Insurance.
Utility Locates & Underground Lines
Prior to any ground-disturbing work (including stump grinding), Statement Tree Care will arrange for public utility locates through Minnesota’s Gopher State One Call (811) service as required by law. The Client is responsible for identifying and marking the location of any private or unmarked underground lines or structures not covered by the public locate service, including but not limited to invisible/pet fences, irrigation and sprinkler systems, private water, gas, or electrical lines, septic systems and drain fields, low-voltage lighting, and drainage tile. Statement Tree Care is not responsible for damage to private or unmarked lines or structures that the Client has not identified in writing prior to work.
Permits, Property Lines & HOA Approval
Where a permit, right-of-way approval, or homeowners’ association (HOA) approval is required for tree work, obtaining such approval is the responsibility of the Client unless otherwise agreed in writing. The Client represents that they own the property (or are authorized to approve work on it) and that the trees to be serviced are located on the Client’s property. The Client is responsible for confirming property lines and for obtaining any necessary consent from neighbors for work affecting shared or boundary trees.
Large Tree Removal
We make every effort to minimize damage to the lawn. Large removals can leave lawn dents, which the homeowner must have repaired by a lawn contractor or repair themselves at the homeowner’s expense.
Stump Removal
Stumps are ground below grade to a depth of 6-8 inches unless specified prior to work. NO topsoil or grass seed is provided unless otherwise specified.
Wood & Debris
Unless otherwise specified in writing, Statement Tree Care will remove and dispose of the wood, brush, and debris generated by the work. If the Client wishes to keep any wood, logs, or wood chips, this must be requested in advance. Any wood or debris left on site at the Client’s request becomes the Client’s responsibility.
Additional Work
If, during the performance of the contracted work, the client requests additional work, their cost can be agreed on-site.
Estimate Validity
All estimates are valid for 30 days from the issue date and are subject to change due to site conditions, access limitations, weather, changes in material costs, or scope adjustments. Any revisions will be communicated and must be approved prior to additional work.
Cancellation Fee
Statement Tree Care charges a 10% cancellation fee for all signed and approved quotes due to the costs of planning, scheduling, and preparation.
Safety Requirements
For safety reasons, all homeowners, occupants, pets, and bystanders must remain indoors and at a safe distance while work is being performed. Tree work involves falling limbs, equipment movement, and other hazards. Statement Tree Care is not responsible for injury resulting from failure to follow safety instructions or remain clear of the work area.
Weather & Rescheduling
Tree services are weather-dependent. Statement Tree Care reserves the right to delay or reschedule work due to unsafe conditions, including snow, ice, high winds, storms, frozen ground issues, or equipment limitations. Weather-related delays do not constitute cancellation; they will be rescheduled to the next available date.
Photography & Media Consent
The Client grants Statement Tree Care permission to photograph and/or record video of the work site before, during, and after service for documentation, portfolio, and marketing use. If photography, videography, or the presence of Statement Tree Care’s content team is not permitted, the Client must notify Statement Tree Care in writing prior to the scheduled service date. Failure to do so constitutes consent.
Payment Terms
Payment is due upon completion unless otherwise agreed to in writing and approved as formal payment terms by Statement Tree Care. Clients not on approved payment terms who fail to remit payment when due will be assessed a $200 late fee. Any unpaid balance may also accrue interest at a rate of 3% per month, calculated from the date payment was due until paid in full.
Collections & Liens
Unpaid balances may be subject to collection efforts, including third-party collections, legal action, and recovery of associated fees and costs. The Client acknowledges and agrees that Statement Tree Care reserves the right to file a mechanic’s lien or similar lien against the property for non-payment, as permitted by applicable law.
Authorization to Proceed
Approval of this contract authorizes Statement Tree Care to perform the agreed-upon work without requiring the Client to be present on-site. A signed contract or approved estimate constitutes full permission to proceed. While Statement Tree Care will make reasonable efforts to provide advance notice of the scheduled service date, specific appointment times are not guaranteed, and work may proceed as scheduling, weather, and operational conditions allow. Approval of this estimate confirms acceptance of all terms and conditions stated above.
Governing Law
These Terms and Conditions and any dispute arising from the services shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-laws principles. The proper venue for any dispute shall be the county in Minnesota in which Statement Tree Care maintains its principal place of business.
Entire Agreement & Severability
The approved estimate, together with these Terms and Conditions, constitutes the entire agreement between the parties and supersedes any prior verbal or written representations. Any modification must be agreed to in writing. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
